Human rights of sexual, gender and gender minorities

The rights of sexual, gender, and sexual minorities (SGMSM), more commonly known as LGBT people, are at the heart of contemporary geopolitical issues—if we consider the instrumentalization of this issue by certain States in current global conflicts—but also of the legal issues of our time. Indeed, the demands made by these minorities for respect for their human rights call into question centuries-old, even millennia-old, legal norms regarding the organization of the family or the registration of individuals in state registers, often called civil status registers. Taking a step back from the ongoing relevance of the subject—countless decisions were handed down while this book was being published—the contributions gathered here aim to address the issue of SGMSM rights through a comparative Franco-Japanese approach, combining disciplinary and thematic perspectives. Written by academics in law or sociology, as well as involving legal practitioners, they make an important contribution to the understanding of the rights of these minorities. Upon leaving this work, the reader will have a much clearer vision of some of the historical and philosophical issues of the subject, of the international and internal standards applicable to these minorities and more specifically those relating to their personal or family identity, to their body or their family resources or those linked to their work and social benefits. The reader will also better understand the specificities of Japanese or French law thanks to the comparative dynamics, but also the dynamics specific to the recognition of each of these three minorities (sexual, sexual or gendered), since they encounter distinct problems, treated by States with attention and in a temporality that sometimes differs greatly from one minority to another.
